1. Acceptance
By creating a PulseIQ account, you agree to these terms. If you are using PulseIQ on behalf of a business, you represent that you have authority to bind that business to these terms.
2. Your Account
You are responsible for keeping your login credentials secure. PulseIQ uses email-based authentication (OTP code or magic link) and does not store passwords. Notify us immediately at hello@pulse-iq.io if you believe your account has been compromised.
3. Acceptable Use
You may not use PulseIQ to:
- Track websites you do not own or do not have permission to track
- Circumvent another party's privacy controls
- Resell access to PulseIQ without an Agency plan and written agreement
- Reverse engineer the PulseIQ tracking beacon or API
- Attempt to access other customers' data
4. Plans, Billing, and Cancellation
Paid plans are billed monthly or annually via Stripe. Annual plans are non-refundable after 14 days. Monthly plans can be cancelled at any time, and you retain access through the end of the paid period. Downgrading to Free is available at any time via the billing portal.
Plan limits for sites, pageviews, and keywords are enforced automatically. Exceeding a limit causes data collection to pause until the next billing period or until you upgrade. We will email you at 80% and 100% of each limit.
5. Data Ownership
You own your data. PulseIQ does not sell, license, or share your site's analytics data with third parties for advertising or marketing purposes. We may use aggregated, anonymized data, never identifiable to you or your sites, to improve the product.
6. Uptime and SLA
PulseIQ targets 99.9% uptime for the tracking endpoint (/api/track) and dashboard. We do not offer a formal SLA on Free or Starter plans. Pro and Agency customers may contact us for uptime commitments.
7. AI Assistant
The AI Assistant on Pro and Agency plans is powered by a third-party AI model. Responses are generated automatically and may contain errors. PulseIQ makes no guarantee that AI suggestions are accurate, complete, or suitable for your specific situation. Do not rely on AI output as professional marketing, legal, or financial advice.
8. Termination
We may suspend or terminate accounts that violate these terms, engage in abusive use, or fail to pay. We will provide notice where reasonably possible before termination. You may terminate your account at any time via Settings -> Data -> Delete Account.
9. Limitation of Liability
PulseIQ is provided "as is." To the maximum extent permitted by law, PulseIQ and EchoDial LLC are not liable for indirect, incidental, or consequential damages arising from use of the service. Our total liability is limited to the amount you paid in the 3 months prior to the claim.
10. Governing Law
These terms are governed by the laws of the State of Florida. Disputes will be resolved in the courts of Hillsborough County, Florida.
11. Changes
We will notify active subscribers by email at least 14 days before material changes to these terms take effect. Continued use after the effective date constitutes acceptance.
